Analysis of the world experience to establish the land market in Ukraine

ANNOTATION

Enactment of the Law of Ukraine «On introduction of changes to some legislative acts of Ukraine concerning conditions of agricultural land turnover» № 552-ІХ, which was adopted by the Verkhovna Rada of Ukraine on December 31, 2020, is an important historic event for the country and particularly for its citizens, who have been waiting for that act since the time of independence declaration. The document will provide the opportunity for exercising the constitutional rights of free disposal of property by physical and legal entities, as well as will secure transparent conditions for purchasing agricultural lands by the citizens of Ukraine. Creation of the legal field for introduction of the market turnover of lands is a crucially important fundamental, contributing to expansion of the investment opportunities in the AIC.

Considering the state-approved Europe-integration processes and prospects of development in that direction, as well as in the sphere of agrarian economics, it is necessary to study the world experience on establishment and performance of the land market as a competitive and investment-attractive phenomenon with maintenance of the gradually achieved positive aspects. In the developed countries, different models of state management concerning regulation of the market turnover of agricultural lands, have many similar features and are focused on protection and security of the national producers’ rights due to a high level of budget support, maintaining their competitiveness at the domestic and foreign, i.e. world, market. Adopting the positive experience of foreign countries, Ukraine should develop its specific transparent model of the turnover of agricultural lands to integrate into the world community. The model should consider the national peculiarities, interests of land owners and land users to increase the Ukraine’s potentially positive impact on the world food market. Such step will also enable handling the terrible situation, caused by the shadow market and corruption, concerning one of the most valuable and largest resources, i.e. land.
